Bill Cosby’s lawyers are asking for a new trial. This time, they’re saying that it was “fundamentally unfair” for the judge to allow a deposition from a civil lawsuit to be used against him in 2018.
According to the paperwork filed on Tuesday, when Cosby gave the deposition, he was under the impression that he was immune from prosecution. In addition, he feels like the testimony from five accusers about incidents that occurred earlier improperly prejudiced the jury against him. To review, the 83-year-old is serving a three- to 10-year prison term after a jury convicted him of three counts of felony sexual assault over a 2004 encounter with Andrea Constand at his Montgomery County home.
A spokesperson for Montgomery County District Attorney Kevin Steele‘s office wouldn’t comment but said prosecutors would file a response in the coming month.
