Ashley Judd has gotten a win in court against Harvey Weinstein. An appeals court has ruled that the actress can sue the disgraced movie mogul over an alleged incident in the 90s.
Judd’s claim was originally tossed by the lower court, on the grounds that Judd was not Weinstein’s employee at the time of their meeting-gone-wrong in the mid-90s. But now the three-panel judge of the 9th Circuit Court of Appeals has reversed that decision, determining that Weinstein did in fact hold power over Judd’s career when he invited her to his Peninsula Hotel room.
The judge has given Judd the green light to proceed with her retaliation and defamation claims, but the harassment claim has been tossed based on California law. Now, the case will head back to the lower court and proceed.
